Five Peaks Mastermind Program — Participation Terms & Data Use Policy

Program Nature

Five Peaks Mastermind provides educational content, coaching, training, and general business tools. Five Peaks Mastermind does not provide data analytics services based on third-party proprietary systems.

No Use of Restricted Third-Party Data

Participants agree not to upload, submit, transmit, or otherwise provide to Five Peaks Mastermind any data, information, or materials that:

  • Are obtained from or derived from proprietary third-party platforms where such use is restricted by agreement (including but not limited to CRM platforms, software systems, or membership platforms);
  • Violate any confidentiality, non-compete, non-solicitation, or data use obligations;
  • Include customer lists, performance metrics, or business data that the participant is not authorized to use outside of such third-party systems.

Participants are solely responsible for ensuring they have the legal right to use and share any data they reference or input.

No Data Processing or Storage by Five Peaks Mastermind

Five Peaks Mastermind does not:

  • Store or maintain participant business data submitted through third-party platforms;
  • Aggregate, benchmark, or compare participant data across users;
  • Provide automated analysis, scoring, or recommendations based on participant-submitted data from external systems.

Any tools, worksheets, or resources provided are for self-directed use only and do not constitute data analysis services.

Participant Responsibility

Participants agree that:

  • They will not use Five Peaks Mastermind to analyze, process, or derive insights from data obtained from restricted platforms;
  • They will not attempt to use Five Peaks Mastermind tools in a manner that violates their agreements with any third party;
  • They are responsible for compliance with all agreements they have entered into with other companies or service providers.

No Affiliation with Third Parties

Five Peaks Mastermind is an independent program and is not affiliated with, endorsed by, or connected to any third-party platforms, including but not limited to CRM providers or software companies.

Non-Solicitation & Respect for Third-Party Relationships

Participants acknowledge that Five Peaks Mastermind does not encourage or induce any participant to:

  • Terminate or reduce their relationship with any third-party provider;
  • Violate any contractual obligations with third parties.

Limitation of Use

Five Peaks Mastermind reserves the right to:

  • Refuse service
  • Remove participants
  • Restrict access

If it determines, in its sole discretion, that participation may create legal or contractual risk.

Acknowledgment

By participating in Five Peaks Mastermind, you acknowledge and agree:

  • You are solely responsible for how you use your business data
  • Five Peaks Mastermind is not responsible for any misuse of third-party data
  • You will comply with all applicable agreements, laws, and obligations

Updates

These terms may be updated from time to time to ensure ongoing compliance and clarity.

By enrolling in or participating in Five Peaks Mastermind, you agree to the above terms.
